The Playpen Enterprises LLC offers three cancellation options\u2014Flexible, Moderate, and Strict\u2014for all boat listings. Hosts choose one per listing; Charterers may cancel at any time. Fees depend on when cancellation occurs relative to the booking start date\/time.<\/p>\n<p data-start=\"469\" data-end=\"669\">Please note that any weather-related cancellations (named storms, thunderstorms, high winds, etc.) are made at the sole discretion of the Captain or Owner and must be assessed on the day of departure.<\/p>\n<h2 data-start=\"676\" data-end=\"692\">1. Flexible<\/h2>\n<p data-start=\"693\" data-end=\"708\"><strong data-start=\"693\" data-end=\"706\">Schedule:<\/strong><\/p>\n<ul data-start=\"709\" data-end=\"863\">\n<li data-start=\"709\" data-end=\"781\">\n<p data-start=\"711\" data-end=\"781\">Free cancellations until <strong data-start=\"736\" data-end=\"748\">24 hours<\/strong> before the booking start time.<\/p>\n<\/li>\n<li data-start=\"782\" data-end=\"863\">\n<p data-start=\"784\" data-end=\"863\">Cancellations within <strong data-start=\"805\" data-end=\"817\">24 hours<\/strong> of the booking start time are non-refundable.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"865\" data-end=\"884\"><strong data-start=\"865\" data-end=\"882\">For Customer:<\/strong><\/p>\n<ul data-start=\"885\" data-end=\"1232\">\n<li data-start=\"885\" data-end=\"1091\">\n<p data-start=\"887\" data-end=\"1091\"><strong data-start=\"887\" data-end=\"923\">More than 24 hours before start:<\/strong><br data-start=\"923\" data-end=\"926\">You\u2019ll receive a full refund less the booking fee (non-refundable). Any ordered food, beverage, or add-ons are non-refundable and must be picked up as scheduled.<\/p>\n<\/li>\n<li data-start=\"1092\" data-end=\"1232\">\n<p data-start=\"1094\" data-end=\"1232\"><strong data-start=\"1094\" data-end=\"1123\">Within 24 hours of start:<\/strong><br data-start=\"1123\" data-end=\"1126\">No refund. Any ordered food, beverage, or add-ons are non-refundable and must be picked up as scheduled.<\/p>\n<\/li>\n<\/ul>\n<h2 data-start=\"1239\" data-end=\"1255\">2. Moderate<\/h2>\n<p data-start=\"1256\" data-end=\"1271\"><strong data-start=\"1256\" data-end=\"1269\">Schedule:<\/strong><\/p>\n<ul data-start=\"1272\" data-end=\"1545\">\n<li data-start=\"1272\" data-end=\"1342\">\n<p data-start=\"1274\" data-end=\"1342\">Free cancellations until <strong data-start=\"1299\" data-end=\"1309\">5 days<\/strong> before the booking start time.<\/p>\n<\/li>\n<li data-start=\"1343\" data-end=\"1465\">\n<p data-start=\"1345\" data-end=\"1465\"><strong data-start=\"1345\" data-end=\"1359\">50% refund<\/strong> of boat rental &amp; captain fees for cancellations <strong data-start=\"1408\" data-end=\"1420\">3\u20135 days<\/strong> before start (booking fee non-refundable).<\/p>\n<\/li>\n<li data-start=\"1466\" data-end=\"1545\">\n<p data-start=\"1468\" data-end=\"1545\">Cancellations within <strong data-start=\"1489\" data-end=\"1499\">2 days<\/strong> of the booking start time are non-refundable.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1547\" data-end=\"1566\"><strong data-start=\"1547\" data-end=\"1564\">For Customer:<\/strong><\/p>\n<ul data-start=\"1567\" data-end=\"2126\">\n<li data-start=\"1567\" data-end=\"1771\">\n<p data-start=\"1569\" data-end=\"1771\"><strong data-start=\"1569\" data-end=\"1603\">More than 5 days before start:<\/strong><br data-start=\"1603\" data-end=\"1606\">You\u2019ll receive a full refund less the booking fee (non-refundable). Any ordered food, beverage, or add-ons are non-refundable and must be picked up as scheduled.<\/p>\n<\/li>\n<li data-start=\"1772\" data-end=\"1987\">\n<p data-start=\"1774\" data-end=\"1987\"><strong data-start=\"1774\" data-end=\"1808\">Between 3\u20135 days before start:<\/strong><br data-start=\"1808\" data-end=\"1811\">You\u2019ll receive 50% of boat rental &amp; captain fees (booking fee non-refundable). Any ordered food, beverage, or add-ons are non-refundable and must be picked up as scheduled.<\/p>\n<\/li>\n<li data-start=\"1988\" data-end=\"2126\">\n<p data-start=\"1990\" data-end=\"2126\"><strong data-start=\"1990\" data-end=\"2017\">Within 2 days of start:<\/strong><br data-start=\"2017\" data-end=\"2020\">No refund. Any ordered food, beverage, or add-ons are non-refundable and must be picked up as scheduled.<\/p>\n<\/li>\n<\/ul>\n<h2 data-start=\"2133\" data-end=\"2147\">3. Strict<\/h2>\n<p data-start=\"2148\" data-end=\"2163\"><strong data-start=\"2148\" data-end=\"2161\">Schedule:<\/strong><\/p>\n<ul data-start=\"2164\" data-end=\"2498\">\n<li data-start=\"2164\" data-end=\"2229\">\n<p data-start=\"2166\" data-end=\"2229\"><strong data-start=\"2166\" data-end=\"2186\">10% booking fee:<\/strong> Non-refundable immediately upon payment.<\/p>\n<\/li>\n<li data-start=\"2230\" data-end=\"2307\">\n<p data-start=\"2232\" data-end=\"2307\">Free cancellations until <strong data-start=\"2257\" data-end=\"2268\">30 days<\/strong> before departure (10% fee retained).<\/p>\n<\/li>\n<li data-start=\"2308\" data-end=\"2415\">\n<p data-start=\"2310\" data-end=\"2415\"><strong data-start=\"2310\" data-end=\"2324\">50% refund<\/strong> of booking charges for cancellations <strong data-start=\"2362\" data-end=\"2376\">14\u201330 days<\/strong> before departure (10% fee retained).<\/p>\n<\/li>\n<li data-start=\"2416\" data-end=\"2498\">\n<p data-start=\"2418\" data-end=\"2498\">No refunds for cancellations within <strong data-start=\"2454\" data-end=\"2465\">14 days<\/strong> of departure (10% fee retained).<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2505\" data-end=\"2606\"><em data-start=\"2505\" data-end=\"2606\">All cancellations under any policy must be made in writing by emailing <strong data-start=\"2577\" data-end=\"2604\"><a rel=\"noopener\" data-start=\"2579\" data-end=\"2602\">charters@theplaypen.com<\/a><\/strong>.<\/em><\/p>\n<h3 data-start=\"2613\" data-end=\"2627\">COVID-19<\/h3>\n<p data-start=\"2628\" data-end=\"2859\">As of May 31, 2022, COVID-19\u2013related circumstances are no longer covered for new reservations. Reservations made before that date may qualify for cancellation if you test positive within 5 days of departure; contact us for details.<\/p>\n<h3 data-start=\"2866\" data-end=\"2888\">Provision Orders<\/h3>\n<p data-start=\"2889\" data-end=\"3104\">All provision orders (food &amp; beverage stocking\/delivery) must be placed at least <strong data-start=\"2970\" data-end=\"2992\">5 days (120 hours)<\/strong> before departure and are non-refundable upon cancellation. Customers must pick up provisions or forfeit refund.<\/p>\n<h3 data-start=\"3111\" data-end=\"3134\">Rescheduling Fees<\/h3>\n<p data-start=\"3135\" data-end=\"3364\">Reschedules incur a fee equal to the original 10% booking fee\u2014unless waived for mechanical failure, Captain no-show, weather-related issues (Captain\u2019s discretion), or vessel inaccessibility. Each request is reviewed individually.<\/p>\n<h3 data-start=\"3371\" data-end=\"3402\">Extenuating Circumstances<\/h3>\n<p data-start=\"3403\" data-end=\"3481\">Exceptions may be granted for documented events such as:<\/p>\n<ul data-start=\"3482\" data-end=\"3914\">\n<li data-start=\"3482\" data-end=\"3532\">\n<p data-start=\"3484\" data-end=\"3532\">Named storms within 100 miles on departure day&nbsp;<span style=\"background-color: transparent;\">(Captain&#8217;s authority only)<\/span><\/p>\n<\/li>\n<li data-start=\"3533\" data-end=\"3603\">\n<p data-start=\"3535\" data-end=\"3603\">Unsafe weather conditions (Captain&#8217;s authority only)<\/p>\n<\/li>\n<li data-start=\"3604\" data-end=\"3645\">\n<p data-start=\"3606\" data-end=\"3645\">Natural disasters affecting the immediate region<\/p>\n<\/li>\n<li data-start=\"3646\" data-end=\"3763\">\n<p data-start=\"3648\" data-end=\"3763\">Mechanical failures causing early termination (pro-rated refund if unremedied within 20% of remaining rental time)<\/p>\n<\/li>\n<li data-start=\"3764\" data-end=\"3809\">\n<p data-start=\"3766\" data-end=\"3809\">Owner\/Captain cancellations or gross negligence<\/p>\n<\/li>\n<li data-start=\"3810\" data-end=\"3843\">\n<p data-start=\"3812\" data-end=\"3843\">Material listing gross inaccuracies that materially affect the experience of the trip to a significant degree&nbsp;<span style=\"background-color: transparent;\">(Captain&#8217;s authority only)<\/span><\/p>\n<\/li>\n<li data-start=\"3844\" data-end=\"3914\">\n<p data-start=\"3846\" data-end=\"3914\">Fraud or safety concerns identified by The Playpen Enterprises LLC<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"3916\" data-end=\"3966\">In this eventuality, the Captain and Boat Owner will work with the Customer to temporarily postpone or reschedule the trip to a future date. If this is not possible, a refund will be given to the customer up to the amount paid less the Platform&#8217;s processing fees. Send documentation of these eventualities to <strong data-start=\"3938\" data-end=\"3965\"><a rel=\"noopener\" data-start=\"3940\" data-end=\"3963\">charters@theplaypen.com<\/a><\/strong>.<\/p>\n<h3 data-start=\"3973\" data-end=\"4029\">Minimum Quality Standards &amp; Owner Responsibilities<\/h3>\n<p data-start=\"4030\" data-end=\"4173\">Owners must ensure listings meet standards of accuracy, safety, and cleanliness, and be available to resolve issues for 24 hours post check-in.<\/p>\n<h3 data-start=\"4180\" data-end=\"4206\">Boat Owner Penalties<\/h3>\n<p data-start=\"4207\" data-end=\"4425\">The Playpen Enterprises LLC may penalize Owners for cancellations or sub-standard listings by blocking dates, applying fees equal to net income, lowering search ranking, posting cancellation notices, or other remedies.<\/p>\n<h3 data-start=\"4432\" data-end=\"4454\">General Provisions<\/h3>\n<p data-start=\"4456\" data-end=\"4562\"><strong data-start=\"4456\" data-end=\"4486\">No Assignment\/No Insurance<\/strong><br data-start=\"4486\" data-end=\"4489\">This Cancellation Policy is not insurance; benefits are non-transferable.<\/p>\n<p data-start=\"4564\" data-end=\"4693\"><strong data-start=\"4564\" data-end=\"4595\">Modification or Termination<\/strong><br data-start=\"4595\" data-end=\"4598\">We may modify or terminate this policy at any time; changes apply only to future cancellations.<\/p>\n<p data-start=\"4695\" data-end=\"4852\"><strong data-start=\"4695\" data-end=\"4715\">Entire Agreement<\/strong><br data-start=\"4715\" data-end=\"4718\">This policy supersedes all prior cancellation agreements. Undefined capitalized terms have the meanings given in our Terms of Service.<\/p>\n<p data-start=\"4854\" data-end=\"5024\"><strong data-start=\"4854\" data-end=\"4873\">Controlling Law<\/strong><br data-start=\"4873\" data-end=\"4876\">This Cancellation Policy will be interpreted under the laws of the State of Illinois and the United States, without regard to conflict-of-law rules.<\/p>\n<p data-start=\"5026\" data-end=\"5182\"><strong data-start=\"5026\" data-end=\"5053\">Limitation of Liability<\/strong><br data-start=\"5053\" data-end=\"5056\">Our total liability will not exceed the boat fees collected from the Renter.
